If sentenced to jail, he may be granted parole.Then another arraignment is held. If the defendant pleads guilty a date for him to be sentenced is set by the judge. If the defendant pleads not guilty, he may request to have a jury trial or be tried by the court without a jury. At the trial, if the defendant is convicted, a date for sentencing is set.Before imposing the actual sentence an investigation by the proba¬tion officer takes place to assist the judge in deciding on a penalty. Centuries ago, as people looked up at the sky, they saw that some stars did not twinkle but wandered across the sky as bright points of light. So they named these "wandering" stars "planets", which means "wanderers" in Greek. There were five planets that could be seen by ancient men. Their names in order from the sun are Mercury, Venus, Mars, Jupiter and Saturn. (2) The ancient Greeks were great watchers of the sky and also great thinkers. As they watched the stars night after night, it was natural for them to think that the earth stood still and the stars, planets, sun, and moon were going round and round the earth in space. They thought the sun was revolving round the earth between Venus and Mars. (3) For centuries, men believed this was how the stars moved. To explain the wandering of the planets, however, was very difficult. (4) Then one day at Krakow University in Poland, about the year A.D. 1500, a young scientist named Nicolaus Copernicus began thinking about the way in which the stars and planets moved. (5) Suppose, Copernicus said, the earth was not at the centre of the stars and the planets, but that the sun was instead. Suppose that the earth itself was a planet just like Mars and Venus and that the earth and all the other planets, rotating on their axes, were round and round the sun at different distances from it. "After all," he said, "since light comes from the sun, it is only proper that the sun and not the earth should be at the centre of everything." (6) The ancient Greeks had made the mistake of thinking that because the stars and planets seemed to move as they looked at the sky, the earth must be still. If you have sat in a train and looked out at the trees rushing by, it is easy to understand their mistake. The trees seem to be moving backwards, but really it is the train that is moving forwards. (7) Not all of Copernicus' ideas were right. Although he thought, correctly, that the moon went round and round the earth, he also thought the stars were fixed on a large ball outside where the planets moved. He thought the stars did not move at all, but only the earth, moon and planets. (8) Copernicus was so frightened of what everyone would think of his new ideas that he did not write them down in a book until he was almost dying. Yet in 1543 he exposed his ideas in a treatise. It was in Latin and had the title "De Revolutionibus Orbitum Coelestium". (9) Copernicus was born at Torun in 1473. He studied mathematics and economics at Krakow, canon law and astronomy at Bologna, and medicine at Padua. He died in 1543 in Frombork, Poland. England and Wales courts Criminal Cases The more serious criminal cases are tried on the basis of a document called the indictment — the defendant is indicted on criminal charges specified in the indictment by the prosecutor. In most cases, the prosecution is on behalf of the Crown (the State) and is handled by an official agency being called the Crown Prosecution Service, which takes the case over from the police who have already investigated most of the evidence. The first stage will be to decide whether it is a prima facie case. This process, called committal, will be dealt with by a magistrate on the basis of evidence disclosed in papers provided by the prosecutor. If the case proceeds, it is heard in the Crown Court. The trial is before a judge and jury. The judge presides over the trial process by attempting to ensure clarity and fairness. The judge’s functions are considering and deciding on legal issues (such as whether a piece of evidence is admissible — should be put before the jury) and instructing the jury as to the correct view of the law relevant to the case. To decide the facts — whose story is more believable — and to apply the law to those facts is the function of the jury. So it is the jury, not the judge, which reaches a verdict on the guilt or innocence of the defendant. In criminal cases, the prosecution has the burden of proof — it must prove guilt, rather than the defendant having to prove innocence. The standard (=level) of proof is heavy — guilt must be proven beyond reasonable doubt. In less serious criminal cases, comprising over 90% of criminal cases, the case is sure to be sent for summary trial in one of over 400 magistrates’ courts. A summary trial means there is no committal and no jury. The trial is before a bench of magistrates. In most cases, there are three magistrates who are “lay” persons — in other words, they are not professional judges nor are they lawyers, but, like the jury, they are persons from the local community. However, there is now an increasing number of “stipendiary” magistrates — paid magistrates who are qualified lawyers. Stipendiary magistrates are, for historical reasons are considered to be most common in London and in other large cities.

Contracts are a very important part of trade and commerce and are vital to doing any form of business locally, nationally or internationally. Contract law is generally derived from a number of sources which are either based on the common law legal system that was inherited and adopted from England in most common law legal systems or from the codes of civil law code legal systems. Contracts are constantly being entered into by individuals and businesses to sell or transfer property, leasing of premises and hiring of employees, locally, nationally and internationally. A legally binding contract is distinguished from other agreements or promises because the contract is enforceable in a court of law if the terms and conditions are not complied with by one of the parties to the contract. The law of contract is a branch of civil law (citizen vs citizen) instead of criminal law (state vs citizen). Civil law differs from criminal law because the main aim or purpose on which an action for breach of contract is based on is to compensate the plaintiff, the party brining the action for any loss incurred as a result of the breach by the defendant. In the event of a breach of a contract between the parties, the main aim of contract law (civil action) is to compensate the plaintiff for losses as a direct result of the breach of contract and not to punish the defendant which is the main objective under criminal law. The main purpose or aim of the law of contract is fundamentally to determine the circumstances under which people are legally bound by the promises that they made whether intentionally (expressed) or unintentionally (implied). In contract law a promise is vital to the issue of intention and enforceability and it is seen as a genuine commitment by a person that something will or will not take place. The person making the promise is called the promisor and the person to whom the actual promise is made is called the promisee.
